Terms and Conditions
Vybe Movement Pty Ltd (trading as Vybe Movement, referred to as “Vybe”) operates a Reformer Pilates studio in Victoria, Australia. Please read these Terms and Conditions (“Terms”) carefully. By accessing our website, booking classes, or attending our studio, you agree to be bound by these Terms.

1. Acceptance of Terms
By registering yourself to attend a session, booking a session, participating in a session (paid or otherwise), physically entering a Vybe Movement studio, or using any of our Services, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions and any associated waiver.
If you do not agree with these Terms & Conditions, you must cease use of the studio and our Services immediately.
Vybe Movement reserves the right to review and update these Terms & Conditions from time to time at its sole discretion. Any updated Terms & Conditions will apply from the date they are published. These Terms apply to all users of our studio and Services unless otherwise stated.
All sessions must be booked through the Momence online booking system.
Vybe Movement reserves the right to restrict, suspend or terminate your access to the studio and our Services where you breach these Terms & Conditions or where we reasonably believe your behaviour may pose a risk to the safety, wellbeing or experience of others.
2. Age Requirements
By participating in sessions at Vybe Movement, you confirm that you are 18 years of age or older.
Participants between the ages of 16 and 18 must have a parent or guardian complete and return the required consent form prior to participating in sessions. If this form has not been completed and returned, Vybe Movement reserves the right to refuse entry to the studio.
Where a participant between 16 and 18 years of age does not have a valid credit card on file, their parent or guardian will be responsible for providing payment for sessions and any associated fees. A valid payment method must be maintained on file for all participants under 18 years of age.
3. Exercise Participation, Health and Risk
Participation in exercise at Vybe Movement involves physical activity that carries inherent risks, including the risk of injury, illness or aggravation of pre-existing conditions.
By participating in our sessions, you acknowledge these risks and agree to participate within your own abilities and limitations. You are responsible for selecting appropriate sessions and communicating any relevant health concerns, injuries or limitations to Vybe Movement and your trainer.
4. Liability and Release
To the extent permitted by law, you, or your parent or guardian in the case of a participant under the age of 18, release and waive any claim you may have against Vybe Movement, and any person or entity involved with Vybe Movement, including its directors, principals, instructors, independent contractors, employees, agents, contractors, affiliates and representatives, arising from participation in sessions, use of the studio or use of our Services.
Vybe Movement and its Representatives exclude liability under these Terms & Conditions, in tort, statute or otherwise, for any injury, illness, damage or loss arising directly or indirectly from participation in sessions, use of the studio, or purchase of a membership, pack or single session, except where liability cannot legally be excluded.
Where any limitation or exclusion of liability is not enforceable for any reason, Vybe Movement’s maximum aggregate liability arising from or relating to any claim by you, howsoever arising, shall not exceed the membership, pack or single session fees paid by you to Vybe Movement during the preceding 12 months.
You indemnify Vybe Movement and its Representatives from any reasonable and quantifiable loss or damage suffered as a result of your breach of these Terms & Conditions.
5. Session Availability and Changes
Vybe Movement will make every reasonable effort to deliver sessions and Services as advertised. However, there may be circumstances where a scheduled class or Service cannot be delivered.
Vybe Movement reserves the right to make changes to session schedules, opening hours, pricing, Services and Trainers at any time without prior notice.
6. Session Cancellations Due to Low Bookings
Vybe Movement reserves the right to cancel a session where fewer than two clients are booked into the session.
Where a session is cancelled due to low bookings, the session credit used will be returned to your account.
Clients will be notified at least three hours before the scheduled session start time. For early morning sessions between 6am and 9am, clients will be notified by 9pm the evening prior.
7. Personal Belongings
Vybe Movement provides designated areas for clients to store personal belongings. However, Vybe Movement is not responsible for the safekeeping of personal items while they are at the studio.
Clients are encouraged to only bring essential belongings into the studio.
You must not interfere with, damage, steal or cause loss of another person’s belongings. Vybe Movement reserves the right to cancel your membership, pack or single session and permanently restrict access to the studio where appropriate.
8. Student Discounts
Full-time students may receive a 10% discount on full-priced memberships and class packs, excluding intro offers, special offers and merchandise.
To apply for a student discount, you must provide a current valid student card to Vybe Movement.
Memberships with a student discount applied are subject to a minimum three-month commitment period. Student discounts expire 12 months from the date of approval and must be reactivated annually.
All applicable membership cancellation requirements remain unchanged.
9. Intellectual Property
Vybe Movement owns or has permission to use all logos, branding, photographs, videos, instructional materials, teaching resources, website designs and other materials created in connection with our Services ("Vybe Movement IP").
You must not copy, reproduce, sell, distribute, licence or otherwise use Vybe Movement IP without prior written consent from Vybe Movement.
10. General Legal Terms
If any provision of these Terms & Conditions is found to be invalid, void or unenforceable, that provision will be severed without affecting the validity of the remaining provisions.
These Terms & Conditions are governed by the laws of Victoria, Australia, and the parties submit to the jurisdiction of the courts of Victoria.
Vybe Movement may assign, transfer or otherwise deal with its rights and obligations under these Terms & Conditions, provided your rights are not materially affected.

To help create a safe, welcoming and enjoyable environment for everyone at Vybe Movement, all clients are expected to follow our Studio Guidelines and any reasonable instructions provided by our trainers and team.
Clients must follow all studio rules, health and safety requirements and trainer instructions at all times.
Clients are expected to treat all Vybe Movement members, guests, trainers and team members with respect. Behaviour that is abusive, threatening, harassing, intimidating, disruptive, or otherwise unreasonably interferes with the safety, wellbeing or experience of others, or the operation of the studio, is not permitted. We welcome feedback and concerns and encourage clients to raise them directly with management so they can be addressed appropriately, rather than discussing them in a way that disrupts classes or the experience of other members or our trainers.
Clients must wear suitable fitness clothing when participating in classes and must wear grip socks during reformer classes to maintain safety and hygiene standards.
Large, excessive or potentially unsafe jewellery must be removed before participating in classes.
Clients must enter and leave the studio respectfully and avoid creating unnecessary noise or disruption before, during or after classes.
Clients must stop participating and notify their trainer if they experience pain, discomfort, injury, illness or any concerns that may affect their ability to safely continue.
Clients must not allow unauthorised third parties to access the studio.
Clients must respect the studio space, equipment and facilities and use all equipment only as instructed by Vybe Movement trainers.

Vybe Movement is committed to supporting the health and wellbeing of all clients who participate in our classes. You are required to inform Vybe Movement and our trainers of any health risks, pre-existing injuries, illness, pregnancy, medical conditions, or anything else that may affect your ability to safely participate in exercise before attending a session.
Where you have a medical condition, injury, or other health concern, we strongly recommend seeking advice from an appropriate medical professional before participating in any exercise program.
Participation in exercise at Vybe Movement involves physical activity that may be strenuous and carries an inherent risk of injury. By participating in our sessions, you acknowledge that you are responsible for selecting sessions appropriate for your abilities, communicating any concerns or limitations to our trainers, and exercising within your own capabilities.
Vybe Movement is not a medical organisation, and our trainers and staff cannot provide medical advice, diagnosis, or treatment. Our trainers provide exercise instruction and modifications within their qualifications and scope of practice.
Where a client has a current injury, is undergoing rehabilitation, or has been advised by a physiotherapist, specialist, or other treating health professional regarding exercise restrictions, Vybe Movement may request relevant information, exercise recommendations, or medical clearance where reasonably necessary to support safe participation.
Exercise instructions, modifications, and equipment suggestions provided by Vybe Movement trainers are intended to support safe participation. You are responsible for communicating any pain, discomfort, or concerns during class and choosing whether to participate in any exercise based on your own physical capabilities.

Vybe Movement trainers may provide exercise modifications for injuries, movement limitations, or individual needs where these can be safely accommodated within a group session environment.
While our trainers will make reasonable efforts to provide appropriate modifications, group sessions are not suitable for all injuries, medical conditions, or stages of rehabilitation. Some injuries or conditions may require individualised assessment, guidance, or treatment from an appropriately qualified health professional before returning to group sessions..
If a trainer reasonably believes that a client's injury, condition, or physical limitations cannot be safely accommodated within the class environment, Vybe Movement reserves the right to recommend seeking advice from an appropriate health professional, restrict participation in certain exercises, or decline participation in a session until appropriate information or clearance has been provided.
Clients are responsible for communicating changes in their health, injuries, pain, or discomfort to Vybe Movement and their trainer before and during class so that appropriate guidance and modifications can be provided.

Vybe Movement may update pricing and/or direct debit terms at any time by providing written notice to clients.
Vybe Movement is not responsible for any fees charged by a client’s bank or financial institution in relation to direct debit payments.
All purchases are final and non-exchangeable. Except where required under Australian Consumer Law, we do not offer refunds for change of mind, unused sessions, late cancellations, or inability to attend due to personal circumstances, including illness or travel.
If a class is fully booked, no refund or credit will be provided.
Gift cards are not redeemable for cash.

All sessions must be booked using the Momence online booking system (“Online Booking System”).
Bookings can be made up to 28 days in advance.
If you have booked to attend a class and wish to cancel your attendance, you must process a cancellation through the Online Booking System only, up to 6 hours prior to the scheduled commencement time of the class.
Vybe Movement will not accept cancellations by phone, email, or any other method other than through the Online Booking System.
Any class cancellation made within the 6-hour window will be considered a Late Cancel.
If you do not cancel your class and do not attend, you will be considered a No Show. This includes classes you are added into from the waitlist.
A Late Cancel incurs a fee of $10. For memberships or passes that include class credits, the class credit will also be forfeited.
A No Show incurs a fee of $15. For memberships or passes that include class credits, the class credit will also be forfeited.
Membership holders are entitled to 2 x Late Cancel fees waived per 28-day cycle. Our booking system automatically checks the 28 days prior to the time of cancellation to determine how many Late Cancel fees have already been waived. For memberships with weekly class credits, any applicable class credit will still be forfeited.
When you purchase a single session, a Late Cancel will result in the forfeiture of your session credit only.
Please note: The No Show fee applies to all bookings and purchase types.
By booking online, you agree to the Late Cancellation and No Show Policy.

Maximum of 8 clients per class waitlist.
If someone cancels, you’ll get a notification in the order you joined the waitlist. You’ll have 45 minutes to confirm/decline via SMS before it’s offered to the next person.
Late Openings: If a spot opens within 30 minutes of the class start time, SMS notifications are sent to all remaining waitlisted clients. The first to confirm secures the spot.

Any introductory offer made by Vybe Movement may only be purchased by new clients who have not yet attended the studio. Introductory Offers will be valid for specified terms, usually expressed in days.
The term of the Introductory Offer will commence on the date of your first visit, and must be activated within 3 months of sign up.
Signing up under another alias, 2nd email address or falsifying your identity we reserve the right to cancel the offer, refuse use of the studio and no refund will be made. No refunds, transfers, suspensions or extensions are offered on unused portions of any Introductory Offer due to illness, injury, change of address, or change of mind.If a Promotional Code is provided to an individual or business, enabling the individual/employees to receive a discounted or complimentary ‘Intro Offer’ the code must not be shared with persons outside that organisation. Vybe Movement reserves the right to cancel a complimentary or discounted Intro Offer/s if they believe this to be the case.

From time to time, Vybe Movement may offer bonus class credits to clients who convert from our Intro Offer to a weekly membership.
When this promotion is active, the following terms apply:
Eligible clients who upgrade to any weekly membership before their Intro Offer expires will receive 4 bonus class credits.
Bonus credits are added when the new membership begins.
Bonus credits can be used at any time within the first month (30 days) of the membership.
Credits cannot be extended, transferred, or exchanged for cash.
The membership must be active, not on hold, and not in arrears at the time the credits are applied.
Offer is valid for one conversion per client.

This promotion is available only during periods stated in Vybe Movement marketing or communications and may be withdrawn at any time.

FOUNDATION MEMBERSHIPS
Foundation Memberships purchased during a studio opening promotion are subject to the following terms and conditions:
Foundation Membership prices are valid for the duration of a continuous membership. Continuous membership means the membership remains active and is not cancelled, including during any approved membership suspension.
If a Foundation Member cancels their membership and wishes to sign up for membership at a later date, they will no longer be eligible for the foundation member promotional rate. A new rate will apply, which is the regular membership rate.
MEMBERSHIP TYPES & MINIMUM TERMS2, 3, 4, and Unlimited classes/week memberships have a 3-month minimum (12 weekly payments).
Applies to standard and discounted memberships.
The term of these Memberships commences on the date that you purchase the Membership or such other date as agreed by Vybe Movement.
By purchasing a Membership, you agree to remain financially responsible for all payments due during the applicable minimum commitment period, regardless of attendance, usage or approved suspension, subject to your rights under Australian Consumer Law and any other applicable laws.
WEEKLY BILLINGAll memberships auto-renew and are billed weekly via Momence.
It’s your responsibility to ensure sufficient funds are available.
Vybe Movement may retry failed payments at any time after the due date.
If payment fails:
Access to classes may be restricted.
Your membership will be placed on hold (locked) until the outstanding amount is paid.
A $15 administration fee may apply to failed payments.
Future weekly payments will continue to accrue while your membership remains active.
You won’t be able to book classes or purchase passes until your outstanding balance has been cleared.
It is the member’s responsibility to contact Vybe Movement to arrange repayment of overdue balances.
Repeated Failed Payments
Ongoing or repeated failed payments may result in:Termination of your membership,
Cancellation of future bookings,
Restriction from holding a weekly direct debit membership in the future, and/or
Referral to a third-party debt recovery agency.
Outstanding amounts must be cleared before any new membership or pass can be purchased.
Debt Collection
If an overdue balance remains unpaid after reasonable attempts to contact you, Vybe Movement reserves the right to refer the debt to a third-party collection agency or pursue other lawful recovery action.This may include overdue Membership fees, fees accrued during any applicable notice period, and any unpaid fees remaining within a Membership's minimum commitment period.
To the extent permitted by law, you may also be responsible for reasonable costs incurred by Vybe Movement in recovering outstanding amounts.
MEMBERSHIP ‘WEEKS’Your “week” begins on your billing day. For example, if you pay on a Wednesday, you can attend two classes between Wednesday and the following Tuesday.
You can use your allocated class credits at any time during your membership week. Unlimited Membership holders may attend unlimited classes during their membership week.
WEEKLY CREDIT ROLLOVER2, 3 and 4 classes/week memberships include a set number of class credits per week and are eligible for weekly credit rollover. Unlimited memberships do not receive class credits and are not eligible for credit rollover.
If a member does not use all allocated credits within a given membership week, unused credits will automatically roll over into the following week only.Rolled-over credits must be used within that following week and will expire after 7 days if not used.
Credits that are not used within this timeframe are forfeited and cannot be reinstated, extended, transferred, or refunded.
ADDITIONAL TERMS FOR ALL MEMBERSHIPS:Membership pricing may change with written notice. Continued membership after the effective date constitutes acceptance of the updated pricing.
Members with active memberships and up-to-date payments are entitled to two late cancellation fees waived per 28 day cycle. Our booking system automatically checks the 28 days prior to the time of cancellation to determine how many late cancel fees have already been waived. Please note that while the late cancellation fee is waived, the class credit is still forfeited.
Pricing for memberships offered to new members may change at any time.
Except where required by law, no refunds or transfers will be provided for unused portions of Memberships.
Memberships are non-transferable. Selling, gifting, or sharing may result in suspension or termination of membership and studio access.

Member benefits apply to all active membership holders, including Foundation and Student Memberships.
UPGRADE/DOWNGRADE MEMBERSHIP
Members on 2, 3, 4 classes/week or Unlimited memberships may switch between eligible membership types:Minimum 1-month commitment before changing.

Change takes effect from the next billing cycle.
Any approved upgrade or downgrade will commence a new minimum commitment period applicable to the selected membership.
By upgrading or downgrading, you agree to the minimum term of the new membership.
SUSPEND (FREEZE) YOUR MEMBERSHIP
We understand that life can be unpredictable, and there may be times where injury, illness, travel, or personal circumstances mean you need time away from the studio.To support this, all memberships include the option to pause your membership for up to 8 weeks per calendar year.
How Suspensions Work
Membership suspensions must be requested by email at least 3 business days prior to your next scheduled direct debit. Your membership must be active and all payments must be up to date at the time of request. Suspension periods pause your membership billing and access for the approved timeframe. Suspension time does not count towards any minimum term commitment.Suspension Limits
The total suspension period available is 8 weeks per calendar year. This allowance can be used in one block or across multiple suspensions.Extended time away:
If you require additional time away beyond your available suspension period, your membership may be cancelled in line with our standard cancellation terms. You are welcome to rejoin at any time when you are ready to return to training.This approach allows us to support members through periods of rest or recovery while ensuring fair access and consistency across the studio.
CANCEL YOUR MEMBERSHIP
To request cancellation of your membership, you must contact Vybe Movement via email: hello@vybemovement.com.au.
Upon receipt of your request, we will provide you with an online Membership Cancellation Form.Cancellation is not effective until the Membership Cancellation Form has been completed and submitted. Two payment cycles' notice is required (please note the minimum commitment period for each membership).
The notice period will commence from the date the completed Membership Cancellation Form is received by Vybe Movement. Submitting a cancellation request via email does not constitute notice of cancellation and does not stop any scheduled payments.
Cancellation requests submitted via text message, social media, in person, verbally, or through the booking app will not be accepted.
You will receive confirmation once your cancellation has been processed. If you do not receive confirmation within 3 business days of submitting your Membership Cancellation Form, please contact us, as your form may not have been received.
Memberships are billed one week in advance. Payments already processed are non-refundable except where required by law.
MEMBERSHIP AGREEMENTSWhen signing up to one of our memberships, you agree to the membership agreement detailed on the Momence app. This agreement authorises the direct debit and lists any conditions specific to your membership package.

Class packs are valid for the following periods from the date of first booking:
5 Class Pack: 3 months
10 Class Pack: 6 months
20 Class Pack: 9 months
Class packs are valid only for the period specified at the time of purchase and are non-refundable, non-transferable, and cannot be paused or extended, except where required under Australian Consumer Law.
Any unused credits remaining after the expiry date will be forfeited.

PRENATAL CLIENTS
Firstly, congratulations!
We understand how important it is to continue moving your body safely throughout pregnancy.Up to 16 Weeks Pregnant:
Clients who are up to 16 weeks pregnant may continue attending our sessions as usual. Please note: our JUMP sessions are not suitable during pregnancy.From 16 Weeks Pregnant Onwards:
If your pregnancy is uncomplicated and you are feeling well, you may continue attending our pregnancy-friendly sessions, subject to the requirements below.Prior to participating in classes from 16 weeks pregnant onwards, all pregnant clients must:
Request and complete the Vybe Prenatal Form by emailing hello@vybemovement.com.au
Obtain clearance from their GP, obstetrician, specialist or other qualified healthcare provider
Return the completed and signed form to Vybe Movement
Complete a mandatory 1:1 consultation with a Vybe Movement trainer prior to returning to group classes
This process allows us to provide appropriate modifications, explain our current prenatal movement guidelines, and support you to move safely and confidently throughout your pregnancy.
As your pregnancy progresses, our trainers may continue to modify exercises and provide pregnancy-specific equipment to help keep you comfortable during sessions. We may also request additional check-ins or reassessments where appropriate.
Vybe Movement reserves the right to refuse or restrict participation in any class where:
the required prenatal process has not been completed
appropriate medical clearance has not been provided
a trainer reasonably believes participation may pose a risk to the client, pregnancy, or unborn child
the class type is considered unsuitable during pregnancy
This policy is intended to prioritise the health, safety and wellbeing of both the client and baby, while ensuring appropriate support within a group fitness environment.

POSTNATAL CLIENTS
We recommend returning to group classes no earlier than 6 weeks postpartum, and only once clearance has been obtained from your GP, obstetrician or other healthcare provider.When returning to exercise, clients are encouraged to begin with sessions that feel manageable and appropriate for their stage of recovery. Our FORM sessions may be a suitable starting point for many postnatal clients, with modifications provided where appropriate.
By participating in classes postpartum at Vybe Movement, you acknowledge that you have obtained appropriate medical clearance to return to exercise and accept responsibility for monitoring your own comfort and physical capacity during sessions.
Please note that our classes are conducted in a group environment. While our trainers will provide modifications and support where reasonably possible, they are responsible for the overall supervision of the class and may not be able to provide continuous one-on-one attention throughout the session.

Private (1:1) sessions must be cancelled via the Momence Online Booking System.
A minimum of 24 hours’ notice is required to cancel or reschedule a private session. Cancellations made within 24 hours of the scheduled session time will result in the full session being forfeited.
If you do not attend your scheduled private session (No Show), the session will be forfeited and a $15 No Show fee will also apply.
By booking a private session, you agree to these Private Session Cancellation Terms.

By registering for or attending any promotional event (including, but not limited to, free classes offered as part of a studio launch or special promotion), you agree not to hold Vybe Movement, its contractors, partners, or employees responsible for any injury, loss, or incident sustained while attending the event.
Media (including photos, videos, and audio recordings) may be captured during promotional events. Your participation in these events is subject to the same Photography, Videography & Media Consent terms provided by Vybe Movement.

By participating in our classes, you understand that Vybe Movement or a professional photographer/videographer may take photos, videos or audio recordings during the course of a class.
You consent to Vybe Movement and its contractors using your image or likeness obtained in this manner for legitimate promotional, marketing and social media purposes.
If you do not wish to appear in photographs or recordings, please notify the studio in writing (hello@vybemovement.com.au) so that a note can be added to your client profile. We will make reasonable efforts to accommodate your request.
